No clubs referred to RFL Operational Rules Tribunal over Salary Cap

No clubs have been referred to the RFL Operational Rules Tribunal for breaching the Salary Cap during the 2007 season following the completion of the RFL’s audits of all engage Super League and The Co-operative National League clubs.
 
This is the first time in two years that no club has been summoned to appear at an RFL hearing for breaching the Salary Cap and is also the last year that clubs in the engage Super League will be audited against a retrospective system.
 
A new proactive ‘live’ system was introduced at the start of this season to the engage Super League and is designed to prevent clubs from accidentally breaching the finite cap of £1.6 million.
 
Although no clubs have significantly breached the Salary Cap during the 2007 season two clubs have been found to marginally breach the cap.   However, in each case, the circumstances that led to each breach and the scale of the breach have meant that each has been dealt with as Minor Misconduct.
 
St Helens have been fined £8,456, a sum equal to the amount of money that the club exceeded the finite Salary Cap by last season.
 
Similarly in The Co-operative National League One, Leigh Centurions have also been fined £5,000 for a Minor Misconduct offence after breaking the ‘50% Rule’ which prohibits a club from spending more than half of their income on player salaries.  This rule is designed to prevent clubs trading beyond their means.
 
This is a breach that Leigh could potentially have avoided had they applied to the RFL for dispensation to work to an Agreed Salary Cap which attempts to safeguard clubs against unexpected downturns in revenue, which potentially cause clubs to breach the ‘50% Rule’.
 
Karen Moorhouse, the RFL’s Compliance Manager, said: “This is the first time in two years that no clubs have been referred to the RFL Operational Rules Tribunal for breaching the Salary Cap and is the last year that engage Super League clubs will be audited on the retrospective system.  The new system we implemented this year is more proactive and a club’s expenditure is continuously monitored throughout the season which should prevent some accidental breaches that that have occurred in the past.
 
“Although retrospective in nature, we do encourage all clubs in The Co-operative National League in advance of the season to work to an Agreed Salary Cap.  This protects a club from breaching the ‘50% Rule’ should their expected income fall.”
